BYLAWS


RATIFIED AT 11/9/2001 CLUB MEETING

Article I

Name and Motto

The name of this organization is "EUREKA! TREASURE HUNTERS CLUB, INC." The motto is "SEARCH WITH CARE."

Article II

Objectives

The objectives of this organization are:

  1. To promote fellowship among all members.
  2. To encourage fellowship with other organizations with similar interests.
  3. To be of service to the community, including law enforcement agencies and historical societies.
  4. To preserve our national heritage.
  5. To preserve and protect our environment.
  6. To leave any property (public or private) in as good or better condition than it was when we arrived.
  7. To promote good will and understanding with all property owners, overseers, and caretakers.
  8. To lobby for or against any pending legislation that would affect our hobby.

Article III

Membership

  1. Membership shall be open to any individual who will abide at all times by these Bylaws.
  2. Every member should attend and participate in as many Club functions as possible.
  3. All members are encouraged to serve on any committees.
  4. All members should conduct themselves in a responsible and respectable manner.
  5. Any member in violation of these Bylaws shall be subject to disciplinary action as determined by the Executive Board, and also shall be subject to being placed on probation.
  6. To be in good standing, a member's dues must be paid for the current year and he must not be on probation.
  7. After one year's membership, any adult member in good standing shall be eligible to run for any elective office.

Article IV

Executive Board

  1. The Executive Board of the EUREKA! TREASURE HUNTERS CLUB, INC. shall consist of:
     President
     Vice-President
     Secretary
     Treasurer
     Newsletter Editor
     Board of Directors (consisting of seven elected members)
  2. The term of office for each member of the Executive Board shall be for two (2) years. Three (3) members of the Board of Directors shall be elected for a period of two (2) years. The remaining four (4) members of the Board of Directors shall be elected for one (1) year.
  3. Should a position become vacant during the year, a special election shall be held at the next General Membership meeting to elect and fill the vacant position. A simple majority vote from the members in attendance at an election meeting shall elect that nominee to office.

Duties of the Executive Board

President

  1. The President shall chair all general Club meetings.
  2. The President shall chair all meetings of the Executive Board.
  3. The President shall conduct all meetings in accordance with a basic outline found in "Robert's Rules of Order."
  4. The President shall have the power to call special Club and/or Executive Board meetings at any time with reasonable notice to the members involved.
  5. The President shall have the power to form committees and appoint chairpersons.

Vice-President

  1. The Vice-President shall assist the President.
  2. The Vice-President shall, in the absence of the President or in his inability to serve, preside at all meetings and perform all duties otherwise performed by the President.
  3. The Vice-President shall assist committees in the carrying out of their functions.
  4. The Vice-President shall be responsible for the coordination of all refreshments for all Club functions.
  5. The Vice-President shall be in charge of new member/guest orientation.

Secretary

  1. The Secretary shall record the minutes of all Club and Executive Board meetings.
  2. The Secretary shall have the power to organize and manage a telephone notifying committee.
  3. The Secretary shall review all Club correspondence and coordinate responses as needed.
  4. The Secretary shall maintain a file of Club correspondence.

Newsletter Editor

  1. The Editor shall notify all members of office election meetings, bylaw change meetings, and other special meetings that the President deems important to the membership.
  2. The Editor shall be responsible for issuing, editing, and mailing of the monthly Club newsletter.
  3. The Editor shall be responsible for the transcription of the Bylaws.
  4. The Editor shall be responsible for maintaining a current membership list.

Treasurer

  1. The Treasurer shall receive all membership dues and issue membership cards.
  2. The Treasurer shall receive all monies and maintain records of all accounts.
  3. The Treasurer shall maintain all Club checking accounts.
  4. The Treasurer/or President/or Vice-President/or Secretary shall write and sign all checks.
  5. The Treasurer may purchase necessary office supplies for the operation of the Club.
  6. The Treasurer shall maintain a petty cash fund at all Club meetings and functions of an adequate amount to meet anticipated needs.

Board of Directors

  1. Board members, along with the other officers of the Club, shall comprise an Executive Board which shall aid in Club policy-making decisions.
  2. The Board of Directors shall represent the Club when dealing with community agencies or other Clubs with mutual interest.
  3. The Board of Directors shall be an extension of the President and Vice-President.
  4. The Board of Directors shall be called in on all special meetings called by the President.

Board Meeting

  1. Any Executive Board member who misses three (3) Board meetings in succession may be removed from that position at the discretion of the Board.
  2. A special election may be held at the next general membership meeting to elect and fill any vacant position.

Article V

Meetings

  1. The EUREKA! TREASURE HUNTERS CLUB, INC. shall hold a regular monthly meeting, the date and time of the meeting to be published in advance in the newsletter.
  2. Special Club meetings may be called by the President for reasons that are deemed important enough to warrant the assemblage of the Club membership. Notice shall be given to the membership as deemed reasonable for the occasion.

Article VI

Membership - Qualifications and Dues

The following memberships shall be available.

  1. Single Adult Membership - age of eighteen or older, one vote per membership.
  2. Family Membership - two adults and/or a single parent with any children under the age of eighteen residing in the same house in a domestic situation, one vote per legal adult.
  3. Junior Membership - any individual under the age of eighteen with voting rights for Finds of the Month and Finds of the Year.
  4. Newsletter Membership - No voting rights, no attendance rights, subscription to Club newsletter only.

The Executive Board shall determine member dues by April of every year.

  1. Dues are due by the May meeting. If members do not renew their membership, they shall be excluded from further Club activities until their dues are paid.
  2. No dues will be refunded.

Article VII

Amendments to Bylaws

  1. EUREKA! TREASURE HUNTERS CLUB, INC. Bylaws may be changed only by a quorum vote of the membership, herein defined as a simple majority of the total Club membership in attendance.
  2. Proposed amendments to the Club Bylaws shall be introduced in writing at any regular Club meeting by any member or officer in attendance. Copies of the proposed amendments must be distributed to the total Club membership by hand, by mail, or electronically, at least two weeks before the next regular meeting.
  3. The cost of copying and distribution of the proposed amendment shall be the responsibility of the person making the amendment proposal or Bylaws change.

Club Library

  1. Any donations of materials to the Club library shall become the property of the entire Club. Should the Club disband, library materials shall be donated to an appropriate non-profit organization in the Club's name.
  2. Any member may loan material to the library, but his or her name must be in or on the material and he or she must obtain a receipt from the librarian for same. Loan material to be returned on request or sooner.
  3. The Club shall not be held liable for any loss of materials on loan to the library from members. Any member loaning material assumes full responsibility.

Members Responsible for Own Safety

  1. All members must be responsible for the well being and safety of their own persons and property.
  2. While Club officers shall attempt to point out some hazards of various outings, it shall be a foregone conclusion that all dangers cannot be foreseen and therefore each member shall assume the responsibility for known and unknown dangers for himself, his family and his property.
  3. Members with children shall be fully responsible for their safety and well being.

Club Liability

  1. Members covenant that they shall not initiate or maintain litigation of any kind against EUREKA! TREASURE HUNTERS CLUB, INC. or any member or officer of EUREKA! TREASURE HUNTERS CLUB, INC. acting on the Club's behalf, to recover damages or to seek any other kind of relief. If any member initiates or maintains litigation in violation of this covenant, that member agrees to pay EUREKA! TREASURE HUNTERS CLUB, INC. for all damages, expenses, and attomey fees incurred.
  2. Any member who violates this covenant and initiates or maintains litigation immediately resigns his or her membership and foreits any dues or fees that have been paid. That member additionally relinquishes any possibility of future membership.

New Members

Half-year dues may be paid by any new member joining the Club after the October meeting. A new member is defined as a person that has not had a paid membership for one (1) year or more.

Visitors

A visitor may attend two Club meetings before deciding to join.

Hunt Sites

  1. Any leads or locations for treasure hunting or coin shooting discussed, suggested, or given by a member to other members of the Club shall be deemed given to the entire membership.
  2. Club officers and members of the hunt committees shall be on their oath not to reveal hunt site locations to any member nor shall they search such sites ahead of the general membership, once the potential hunt site has been deemed an official Club hunt site.
  3. Prior to such outings the membership shall be informed of the following:
    1. Date, time, and convenient meeting place near the site.
    2. Driving time or mileage to the meeting place.
    3. Terrain and environment to be encountered enroute and at site, e.g., gravel road, 4-wheel drive necessary, two-mile hike, mountains, marsh, elevation, mosquito repellent, water, etc.
    4. Finds expected, e.g., treasure cache, coin shooting, battle sites, ghost towns, etc.
  4. Relics, artifacts, and individual coins discovered shall remain the property of the person finding them.

Probation

  1. Probation can be placed on any member who blatantly disregards the Club's Bylaws or Treasure Hunters Code of Ethics.
  2. Any member of the Club in good standing may bring charges of misconduct against any other member of the Club. Those making the charges must report the incident as well as present evidence to an Executive Board member within a reasonable amount of time after the alleged incident.
  3. The Board member shall report to the rest of the Executive Board, and the Board shall determine the course of action to be taken. Evidence of misconduct may be, but not limited to, physical evidence, photographs, video, or an eyewitness account.
  4. Probation shall be at the discretion of the Board to determine duration and severity of the reprimand and shall be determined on a case-by-case basis. Penalty may include one or more of the following, but not necessarily limited to;
    1. Member may not enter any finds into the Find of the Month competition.
    2. Member may not vote for Find of the Month.
    3. Member may not be eligible to hold office.
    4. Member may be removed from office.
    5. Member may not be allowed to participate in drawings.
    6. Member may not be allowed to participate in Club hunts.
